Waitlist Pro - Terms of Use

These terms apply to the Waitlist Pro app for Wix ("Waitlist Pro", "the app"), made by AK Digital (Anna Kheifets), Ashqelon, Israel ("we", "us"). By installing or using Waitlist Pro you agree to these terms and to the Wix App Market terms.

1. The service

Waitlist Pro lets a business that uses Wix Bookings keep a waitlist for its appointment services. People join from a form on the site, and when a booking is cancelled, declined or rescheduled, the app emails the people who match the freed time through the site's Wix Automations, and can let them confirm that time with one tap. Some features require a paid plan.

2. No reservation of times

Waitlist Pro does not hold appointments for anyone. An offer email tells people that a time looks open; the time is only taken when it is booked in Wix Bookings. With one-tap booking (on by default, you can turn it off in Settings), the person who got the email can confirm the time on your service page, and the app then creates that booking in your Wix Bookings for them, under their own name and contact details and only after they press the confirm button. One-tap booking is never used for services that must be paid online: those people continue to your booking calendar to book and pay. In first-in-line mode, the hold time only controls who is emailed first. Anyone can still book the time during the hold. Before sending, the app checks with Wix Bookings that the time can be booked, but a time may be taken by someone else before the person who was emailed books it.

3. Your responsibilities

You are responsible for your site, your settings, your business and your communication with your clients. In particular:

• You are the controller of the personal information of the people who join your waitlist. You must have a lawful basis to collect it, mention the waitlist in your site's privacy policy, and answer requests from people who want to see, correct or delete their information (you can delete an entry, and its contact, from the dashboard).

• When you add someone to the waitlist by hand, you confirm that they agreed to receive emails about open times.

• Offer emails are sent by your site's Wix Automations. You are responsible for their wording and for keeping them active, and they count toward your site's email quota under Wix's terms.

• Waitlist Pro depends on Wix services (Bookings, Automations, Contacts and the CMS). If a Wix service is unavailable or an event from Wix is delayed or missed, an offer may be sent late or not at all. The "Check for open times" button in the dashboard lets you catch up on times that opened without a booking change (for example, new working hours).

4. Plans, payment and cancellation

Paid plans are sold and billed by Wix, including free trials, renewals, cancellations and refunds, under Wix's billing terms. When a paid plan ends, the site moves to the free plan: new sign-ups are limited to the free monthly amount, first-in-line mode switches to emailing everyone who matches, up to your notification cap, and stats are hidden. Existing entries are kept.

5. Acceptable use

Do not use Waitlist Pro to send messages people did not ask for, to collect information for any purpose other than offering appointments, to mislead clients, to break the law (including privacy and anti-spam laws), or to interfere with Wix or with the app.

6. Intellectual property

Waitlist Pro and its design and code belong to AK Digital. You get a non-exclusive, non-transferable right to use the app on your Wix site while it is installed. Your content and your clients' information remain yours.

7. No warranty

Waitlist Pro is provided "as is". We work hard to keep the app accurate and reliable, but we do not guarantee that it will be error-free or uninterrupted, that every freed time will be detected, or that any offer will lead to a booking.

8. Limitation of liability

To the maximum extent permitted by law, AK Digital will not be liable for indirect or consequential damages, lost bookings, lost sales or lost profits arising from the use of Waitlist Pro, including an offer that was sent late, not sent, or sent for a time that was no longer available. Our total liability is limited to the amount you paid for Waitlist Pro in the 12 months before the claim.

9. Changes

We may update the app and these terms. If we make important changes, we will update the date above and let you know in the app. Continued use means you accept the updated terms.

10. Law

These terms are governed by the laws of the State of Israel, and the courts of Tel Aviv have exclusive jurisdiction.
